1. Introduction

These Terms of Service ("Terms") govern your use of Exergist.com (the "Site") and any services we provide for registering, renewing, transferring, or managing internet domain names (the "Services"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, stop using the Site immediately.

2. Acceptance of Terms

Your continued use of the Site constitutes acceptance of these Terms, our Privacy Policy, and any additional policies referenced herein. We may update the Terms at any time; the most recent version will be posted on the Site. Continued use after changes means you accept the revised Terms.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts. If you are acting on behalf of a company or organization, you represent that you have authority to bind that entity.

4. Account Registration

Account Creation: To purchase a domain you must create an account, providing accurate, complete, and current information.

Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Termination: We may suspend or terminate accounts that violate these Terms or applicable law.

5. Domain Registration & Management

Availability: Domain availability is checked in real-time. We do not guarantee that a domain will remain available between the moment you search and the moment you complete checkout.

Registration Period: Domains are registered for the period you select (typically 1–10 years). Renewal is required before expiration to retain ownership.

Transfer: You may transfer a domain to another registrar only if the domain is eligible and you comply with the registrar's policies and ICANN rules.

6. Pricing, Payment, and Billing

Fees: Prices displayed on the Site are in USD unless otherwise noted and include applicable taxes where required. Fees are subject to change with notice.

Payment Methods: We accept major credit cards, debit cards, and approved electronic payment methods. All payments are processed securely.

Renewal Charges: Auto-renewal (if enabled) will charge the renewal fee to your selected payment method prior to expiration.

Failed Payments: If a payment fails, we will notify you and may suspend services until the balance is settled.

7. Refunds & Cancellations

Domain Registrations: Registrations are non-refundable once the domain is successfully registered.

Pending Orders: If you cancel a pending order before the domain is registered, we will refund any amount already charged, less any processing fees.

Renewals: Renewals are also non-refundable once processed, except where required by law.

8. Intellectual Property

Your Content: You retain ownership of any trademarks, logos, or content you associate with your domain. You grant us a worldwide, royalty-free license to use such content solely to provide the Services.

Our Rights: All software, designs, text, and other materials on the Site (excluding your domain content) are owned by us or our licensors and may not be copied, modified, or distributed without permission.

9. Prohibited Uses

You may not use the Services to:

  • Register or transfer domains that infringe third-party rights.
  • Engage in illegal activities, spam, phishing, or distribution of malware.
  • Misrepresent yourself or your affiliation with any person or entity.
  • Violate any applicable local, national, or international law.

Violations may result in immediate suspension or termination of your account and loss of the domain(s).

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation of the Site.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the specific domain(s) involved in the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Exergist.com, its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of:

  • Your breach of these Terms.
  • Your violation of any law or third-party right.
  • Any content you submit or associate with a domain.

13. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, upon written notice. Upon termination, any outstanding fees become immediately due, and you lose any rights to the domain(s) unless otherwise required by law or registrar policy.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the courts located in British Columbia. You consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may revise these Terms at any time. Revised Terms will be posted on the Site with an updated "Last Updated" date. Your continued use of the Services after posting constitutes acceptance of the new Terms.
